7. ORDINANCE of the Township Council of the Township of Toms River, Ocean County, New Jersey, amending and supplementing Chapter 54 (Department of Public Works) of the Township Code, to establish tenure for the Director of Public Works, in accordance with N.J.S.A. 40A:9-154.6. FIRST

8. ORDINANCE of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing eminent domain proceedings to acquire a portion of Block 393.03, Lot 16.01, in the Township of Toms River, for the completion of a grant funded sidewalk and drainage project along East Whitty Road. FIRST

9. ORDINANCE of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the acquisition of a portion of Block 393.03, Lot 16.02, on East Whitty Road to complete a grant funded sidewalk and drainage project. FIRST

10. ORDINANCE of the Township Council of the Township of Toms River, Ocean County, New Jersey, amending and supplementing Subsection 4 (Division of Engineering) of Chapter 48 (Department of Engineering, Construction Services, Code Enforcement and Community Development) to establish the part-time position of Disaster Recovery Ombudsman. FIRST

11. ORDINANCE of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the establishment of a Government Energy Aggregation Program. FIRST

12. ORDINANCE amending and supplementing Section 477-59 (Schedule I: No Parking) of Chapter 477 (Vehicles and Traffic) of the Code of the Township of Toms River, Ocean County, New Jersey, repealing the no parking prohibition on both sides of Colfax Street for its entire length, and establishing a two hour time limit parking prohibition on the North side of Colfax Street for its entire length. FIRST

13. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, urging State and Federal representatives to require FEMA to respond to the Township’s objections to the advisory base flood elevation maps published on December 15, 2012.

14. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, establishing unilateral right of entry onto private property to facilitate debris removal from Hurricane Sandy in accordance with directives from the Federal Emergency Management Agency.

I. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the Tax Collector to cancel any property tax refund or delinquency of less than $10.00.

J. RESOLUTION appointing members of the Mayor’s Advisory Committee on Developmental Disabilities.

K. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the Business Administrator to execute a Municipal Recycling Tonnage Report Form for 2012 for submission to the Department of Environmental Protection and Energy.

L. RESOLUTION amending RESOLUTION of the Township Council of the Township of Toms River, Ocean County, State of New Jersey dated November 13, 2012, authorizing award of negotiated contracts for snow plowing services- 2012-2013 Winter Season, to add one (1) additional contractor, RB Construction.

M. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing award of contract to Garden State Bobcat, Inc., as low bidder meeting all the specifications, for the purchase of one (1) new and unused compact Track Loader with attachments, for the Department of Public Works, in the total maximum amount of $81,536.26.

N. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the Mayor and Clerk to enter into an agreement with Lynswell Group, Inc. and Log Tech for the marketing of recycled electronics for the Department of Public Works.

O. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the award of contract to CDW-G, Inc. for the purchase of Barracuda Web Filter for the Department of Police, and the IT Department, off the Middlesex Regional Education Services Commission Cooperative Pricing System, in the total maximum amount of $24,220.00.

P. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing a contract to vendor with State contract, York Telecom Corporation, for the purchase of video teleconferencing equipment and services for the Municipal Court, in the total maximum amount of $46,456.90.

Q.RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing an award of an emergency contract to Earle Asphalt Company, as low bidder, for the Ortley Beach – Ocean Terrace Sand Reclamation Project, for the Engineering Division, in the amount of $553,120.00.

R. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing an award of an open-ended contract to All Time Tire Services, Inc., as lowest bidder per line item, over two years, for retreading and repairing pneumatic tires for the Department of Public Works, and rebidding items A and B, which were rejected as excessive.

S. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing payment to Music Management Associates c/o Frank Hughes, in the amount of $8,881.00 and the Briartones, in the amount of $500.00, for Summer concert series- 2013, in the total maximum amount not to exceed $9,381.00.

T. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, amending a resolution adopted on December 26, 2012, which authorized award of contract to Pine Belt Chevrolet, who submitted the lowest proposal, for the purchase of two (2) with a maximum of four (4) 2013 4WD Crew Cab Pickup Trucks- 2013 Chevrolet Silverado 2500 HD 4WD Crew Cab, for the Department of Parks, Buildings, and Grounds, at a total cost of $33,856.80 per truck, for a total maximum amount of $67,713.60 for two (2) trucks, to correct the total amount per truck to $35,429.00, for a total maximum not to exceed $70,858.00 for two (2) trucks with plows.

U. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the award of contract to Storr Tractor Company for the purchase of one (1) replacement Toro Groundsmaster 4000-D Mower for the Department of Parks, Buildings, and Grounds, off the Middlesex Regional Cooperative Pricing System, in the total maximum amount of $54,875.91.

V. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, designating the officials authorized to execute documents required by the Ocean County Landfill for the disposal of non-friable asbestos recovered from Township property.

W. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the Mayor to execute and the Township Clerk to attest to agreements for the collection of solid waste and recyclable materials for qualified private communities and not-for-profit entities.

X. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the execution of a tri-partite contract among the Township of Toms River, Lake Ridge Homeowners Association, Inc., and Turf Masters, Inc., for reimbursement of snow removal expenses pursuant to the Municipal Services Act, N.J.S.A. 40A:67-23.1 to -23.8.

Y. RESOLUTION accepting maintenance guarantees and releasing performance guarantees for Major Site Plan known as Bayshore Enterprises, Inc., Block 412.12, Lot 29 (1436 Lakewood Road).

Z. RESOLUTION authorizing the retention of the testing services of J.R. Henderson Labs Inc. for laboratory groundwater analysis of the water in the vicinity of the landfill for the year 2013 in the maximum amount not to exceed $7,440.00.

AA. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, extending certain professional service contracts to February 26, 2013.

BB. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the award of an emergency contract to vendor with State contract, Motorola Solutions, Inc., for the emergency purchase of radio communications equipment and accessories, for the Department of Police, in order to communicate with each other and outside entities while dealing with the effects of Hurricane Sandy, in the total maximum amount of $219,946.10.

CC. RESOLUTION of the Township Council of the Township of Toms River, Ocean County, New Jersey, authorizing the creation of an Economic Development and Community Program.
